MORRISTOWN CITY COUNCIL MINUTES
    Special/Work Session Meeting 
    April 19, 2010
     

    Members Present:  Mayor Kurt Wolf and Councilmember’s, Matt Valentyn, Verdis Flaten and Lisa Karsten

    Members Absent: Jeff  Lang

    Others Present:   Becky Kuball City Clerk, Dave Osborne, Police Dan Morris, Jack Schwichtenberg, Kristalyn Morris, Rich Revering, Mark Morris, Tim Minske, Randy Timm, Danny Timm, Jim Lonegan, Herb Krueger and Dave Sanderson

    A special/work session meeting of the Morristown City Council was called to order on Monday, 
    April 19, 2010 at 7:00 p.m. in the Council Chambers at 402 Division Street South by Mayor Kurt Wolf.

    The Pledge of Allegiance was recited.

    PeopleServices Report: 
    Sanderson stated that March went well. He had a couple of companies come in and look at the chlorination/disinfectant pumps. What we have is working for now. Sanderson will get 3 bids on the replacement.
    Still applying bio solids until the farmer gets in the fields. 
    Motion by Valentyn seconded by Karsten and motion carries to accept the PeopleServices report at given.

    Skywarn Report: Dan Morris stated it was a quiet month.

    Community Center Report: 
    Motion by Karsten seconded by Flaten and motion carries to accept the Community Center report as printed.

    Maintenance Report: 
    Wolf asked Minske if he got what he needed for his weed whip. Minske stated that he had.
    Valentyn asked if there was any more information on the generator. Minske said that he had taken it to Cedar Lake Electric and they also said that they would not recommend changing to single phase. “You will burn out the motor if you do”. Minske said he has someone interested in purchasing the one we have but he is in the field right now, so Minske will talk more with him after the field work is done.
    Motion by Valentyn seconded by Flaten motion carries to accept the maintenance report as given.

    PeopleServices Contract: 
    Krueger said he was interested in renegotiating the contract with the city. Krueger would like to set up a meeting with the Maintenance person and 2 council members and see if they can come up with a new contract. The city is required to give a written 90 day cancelation notice or the contract is renewed for one year. After some discussion it was decided that the council would not like to continue with the current contract and would like to renegotiate the contract or check out other options.
    Motion by Karsten seconded by Valentyn and motion carries to send a letter to PeopleServices and cancel our current contract as of September 2010. 

    Motion by Karsten seconded by Valentyn and motion carries to accept Resolution 2010-2 with one change to discharging of any archery type weapons.

    Peddler ordinance tabled until next meeting.

    Ordinance 2010-2 there was some discussion about the animal ordinance. Flaten said he checked with Northfield and Faribault and neither of them allow farm animals in the city limits. Mark Morris stated that the city cannot have conflicting ordinance and they are sending the original recommendation back to the council to not allow farm animals within the city limits in any zoning district. Dan Morris talked about animal units and if you allow one animal unit equals 1000 pounds so that is equivalent to 1 steer, 1 horse, 4 hogs, 25 turkeys, 167 broiler chickens or 250 laying hens. Zoning members stated that none of the community members that objected to this change attended the last zoning meeting to discuss a compromise as they stated they would.

    Motion by Valentyn seconded by Flaten and motion was voted by resolution Karsten-Yes, Valentyn-Yes, Flaten-Yes Wolf-No to adopt ordinance 2010-2 motion carries.
    ORDINANCE 2010-2

    AN ORDINANCE AMENDING SECTION 91.04 OF THE 
    MORRISTOWN CITY CODE
     

    THE CITY COUNCL OF THE CITY OF MORRISTOWN DOES ORDAIN:

    Morristown City Code § 91.04 is hereby deleted in its entirety and the following is substituted in its stead:

     “§ 91.04 FARM ANIMALS.

     The keeping of farm animals shall be prohibited in all zoning districts.  An exception shall be made to this section for those animals brought temporarily into the city as part of an operating zoo, veterinarian clinic, scientific research laboratory, or a licensed show or exhibition.
     (Ord. 2010-2, passed 4/19/2010)”
     

    Passed and adopted this 19th day of April, 2010, with the following vote: Aye_3___; No__1__; Absent __1____.

    Ditch by Denzer’s was tabled until the next meeting.

    Illegal sump pumping on neighbor’s yard; after some discussion it was decided that Osborne would go and talk to the party that is doing the sump pumping and let them know that they need to pump their water in a different direction.

    Motion by Karsten seconded by Flaten and motion carries to accept the January 2010 financial report for $399,167.70

    Motion by Karsten seconded by Valentyn and motion carries to accept the February 2010 financial report for $357,555.27

    Feed shed falling down by the co-op, Osborne will talk with the owners about cleaning it up before dam days.

    Motion by Flaten seconded by Valentyn and motion carries to approve rate per hour for Timm Trucking and Dahles Enterprises.

    Motion by Valentyn seconded by Flaten and motion carries to approve the commercial club to sell strong beer and Bacardi if they choose at the dam day’s celebration.

    Request for a Moratorium for farm animals and livestock buildings was not needed.

    Zoning board would like to make an ordinance that requires a permit needed to put windows, siding and roofs on buildings with the permit fee to be $25
    Motion by Karsten seconded by Flaten motion carries to set a hearing for Ordinance 2010-5 on May 17, 2010

    Motion by Flaten Seconded by Valentyn motion carries to accept the claims and accounts as printed.

    Correspondence and announcements: Kuball stated that the dog clinic went well. We registered 111 dogs. Osborne requested a print out when we get it done.
     

    Motion by Valentyn seconded by Flaten and carried unanimously to adjourn. The meeting adjourned at 
    8:17 p.m.
